Single mother’s legal gun permit may get her three years in prison

A 27 year-old Pennsylvania resident is being punished in a case that has garnered quite a bit of controversy.  Shaneen Allen is now facing three years in a New Jersey prison because she was honest with a police officer about the gun that she had a permit to carry. The only problem was that her concealed carry permit isn’t transferable across state lines.

Allen made the decision to get a gun due to the fact that she works late, is a single mother, and had been robbed a few times. One of her family members said that it would be a good idea to get some protection for herself and for her family. Before getting a gun, she went to take a gun safety course, which she completed. She then applied for a concealed carry permit. Only after completing the course and obtaining her permit did she purchase a gun legally.

One day while driving through New Jersey, she was stopped for a minor traffic offense. While speaking with the officer, she was honest and told him that she had a gun on her, but also had a permit for it. What she didn’t know is that her honesty would send her to jail. She did not know that her permit did not transfer over state lines and she was technically carrying a weapon illegally. An illegal weapons charge is a felony according to New Jersey’s gun laws. The minimum sentence is three years in prison. Even though Allen does not have anything on her criminal record, she still may go to prison.

There is a divisionary program in New Jersey that would allow her to skip any time behind bars, but the judge denied her entry into this program. Unfortunately the judge does not have much discretion in this case and told Allen that her honesty just got her into trouble. Do you think that time behind bars is appropriate for this woman who did nothing wrong and was completely honest with the police?

She should be given a warning and set free. Next thing is to get a national permit. Never volunteer any information!

      Bishop Hall,
I agree with you in reference to the lady should be given a warning and sent home and that she should get a national permit however, I do not aagree with you that she should have with held the information that she was carrying a gun. I would think it better to be forthright up front than to have the officer find the gun through a search.

There is no national gun permit for civilians, either you are in active duty or retired law enforcement. One has to research what state will accept the CCL from another state.

    Damn shame!!!

    July 15, 2014 at 3:12 am

Unfortunately, when she stated that she had a gun,she broke the law due to transport issues against inter-states statutes. This being the case, this young lady did all the right things to obtain this weapon and should not be penalized for her mistake. She has no arrest record and should not be treated as a felon and/or a criminal. She was honest with the authorities and they should take that into consideration. If this young lady receives any prison time,we need to make sure that this situation be broadcast until she is set free. She simply made a mistake!

I thought in the United States the truth should set you free. I forgot the States are only united in name only. What the purpose of having a permit legally if you can’t carried it in any state. The fear of being black get you in trouble in these United States!!!! I pray the judge in this case understand her situation.

It’s been like this in NJ for some time. Her permit should be recognized in NJ just like NJ permit holders could be recognized in Philly. Is it possible to get robed in NJ also? All leaders should get together and make it legal for a carry permit be recognized in all states. Florida carry permit is recognized in other states. This law needed change a long time coming IMO.

It LOOKS LIKE A SITUATION WHERE YOU ARE DAMNED IF YOU DO,DAMNED IF YOU DON ‘T!! She should be given a break and given a warning and charges dropped! I DO NOT THINK IT WAS INTENTIONAL.

I’d like to see the research comparison on how many black people get 3+ years sentences for this particular “offense” as compared to whites under the same circumstances. Please don’t be surprised by the results. All I’m saying is that, if she had been white, we wouldn’t be having this conversation right now!

She needs to go to jail she took a class that explained where she could not and could carry a firearm it may sound harsh but if you’re in New Jersey or any state does not allow you to carry a firearm you need to move if you cannot protect yourself and must depend on somebody else’s firearm to protect you
Somethings wrong I no longer buy things over the Internet from states that don’t allow firearms and I urge you to do the same but back to this lady yes she needs to go to jail you chose to live in a state that don’t allow you to protect yourself now you got to suffer consequences sounds harsh but like I said this is the way it is this is the law

Seriously, a single mother who works, has no arrest record should be put in jail?

Don is the source of people who support these incomprehensible laws, a typical tea-partier who is for anything that makes life difficult for people who he knows are his superiors; they must be held back are he will lose everything that he and his ancestors stole. (he thinks). Projecting his prejudices based in fear of Justified Consequences.

She would have been better off if her name was George Zimmerman and she KILLED a child. THEN SHE WOULD NOT GET ANY JAIL TIME.

Don you are a moron. You should be arrest for being stupid. NJ gun laws are backwards, because they require no intent. The NJ gun laws doesn’t make a difference between a criminal with a illegally obtain firearm and an out state person who lives right over the border who made an honest mistake. NJ gun laws make law abiding citizen victims. She would get less time for shooting someone in this ass backward state.

The Constitution is the Supreme Law of the Land and protects the ‘Peoples’, not the “persons” Right to keep and bear arms. How can it be a “crime” if there is no injuried party! Learn basic law, cause the BARed attorneys won’t raise the question, you have to! The prosecutor is in ‘contempt of court’ for bringing a suit in the name of a ‘fictitious plaintiff’, State of New Jersey, Inc.

I think she should get a warning as well. Its blatant racism. Its just like the other black mom who had a gun permit as well and shot a warning sign in the air. They we’re trying to give her some years as well. Smh its crazy for no reason.

I have a neighbor that had a gun one day and stuck it in her pants & kept coming outside showing that she had a gun. Later that day she was in her door and pointed at the gun and pointed at the gun as if to say this is for you.
I called the police and the police officer said she said she had a cell phone.
There were 2 witnesses to the gun earlier that day when she kept coming outside with it tuck in her pants but, it appears because she has a GREAT FRIEND that is on the force that she gets a pass. Nothing was follow-up with the witness…Nothing!!! A Police Force that takes pride in being May Berry, even referring to themselves as being May Berry. Not all of the Officers are so ignorant…just a select few.

My concern is that they never paid attention to the gun and was told about it even had a witness…that was completely ignored..If something ever happens behind this then the only thing if my life is taken the only compensation will be them being sued. These Officers do not care because the money does not come directly out of their, when you speak about guns and different scenarios then each one is different.

This gun situation with people that should not have guns will only stop once it harms someone that is putting the guns out there each situation is different..According to the Officer and his Commanding Chief

Did she harm anyone? Did she threaten you? What type of neighborhood do both of you live in? Is she elderly?

I lived in a white upperclass neighborhood at one time and I had to carry a gun just to take the trash out.

Rest assured, you don’t know anything about the gun laws in your city, county or state, let alone know what is going on in that woman’s life.

So I suggest that you leave well enough alone and from this moment on mind your own business.

Honesty is the best policy because had they searched her and found the gun, she would just be in more trouble. With all the thugs they have in the east I cannot believe they are going to charge this lady with a felony! An intelligent judge knows that each case should be tried on its own merits, only a dumb ass would not! Should she make it out of this she needs to read up on the gun laws per state.

When you take lessons on how to use firearms they give you instructions on every state in the U.S. that allow and dont allow you to carry concealed weapon. Are all still stuck on stupid about cops giving blkppl a break now wheres that happenin? She knew better. Sucks to be her. We’ll see her in three years. Some blkppl stay breaking the law then turn around and expect a break. We blk the law is white that aint changing. Stop doin stupid sheit that gets yall locked up.

This is some bullshit! You have an old perverted ,rich ,white ,step-father molesting his wife’s daughter (i hope she cuts his penis off ,when she gets older and does no time)a young ,rich ,spoiled, white boy driving drunk killing and paralyzing people. These two low-life sons-of-bitches do no time at all for their crimes. And you mean to say to me, this woman us expected to do time for a victimless crime! Where is the justic in that? Shit like this is one of the reasons I dont salute or recite the pledge of allegiance to that damn red, white, and blue flag with those 50 stars. There’s no way in hell you can tell me it represents any one of color, mainly AA. Since Zimmerman killed Trayvon, quite a few Hispanics feel they’re on the same levels as caucasians, probably felt that way before then. The United States is full of shit, starting with this so called judicial system.

Our mouths get us in trouble. If it was a minor traffic incident all she would have gotten is a ticket, there would have been no reason to search her car. If asked say no to a search.

  30. Jeana

    July 15, 2014 at 3:39 pm

What a sad case. She did everything right! OK, she was wrong according to the law, but I am very sure if she had known about the State of N.J. her carrying the gun was considered illegal in that state, I would put my life on the fact that she would have followed that law and not carried the gun across state line. Going by her history of honesty and no other arrest whatsoever, the woman should be let go. A warning should be sufficient enough. Law Enforcement, go look for the real criminals, the ones that need to be put in jail.

      July 15, 2014 at 10:44 pm

She did everything right, but you are forgetting. They need black slave labor in the prisons, so any reason, wrong or right, is justifiable by the system.

I think the writer meant diversionary program, rather than divisionary program.

[A diversion program in the criminal justice system is a form of sentencing and such programs are often run by a police department, court, a district attorney’s office, or outside agency designed to enable offenders of criminal law to avoid criminal charges and a criminal record. Problem-solving courts typically include a diversion component as part of their program. The purposes of diversion are generally thought to include relief to the courts, police department and probation office, better outcomes compared to direct involvement of the court system, and an opportunity for the offender to avoid prosecution by completing various requirements for the program.[3] These requirements may include:

Education aimed at preventing future offenses by the offender
Restitution to victims of the offense
    Completion of community service hours
Avoiding situations for a specified period in the future that may lead to committing another such offense (such as contact with certain people)

Diversion programs often frame these requirements as an alternative to court or police involvement or, if these institutions are already involved, further prosecution. Successful completion of program requirements often will lead to a dropping or reduction of the charges while failure may bring back or heighten the penalties involved.]– Wiki

On what grounds was Ms. Allen denied entry into the program, and why did the judge not have much discretion in this case? Was it because she was an out of state resident? Clearly she does not deserve to be imprisoned, but I don’t know what legal recourse she has.

I got my license in Missouri. During the class I was told about states that did not honor my license. New Jersey was not one of them. I was told that the State of Ohio would not honor it, if you stayed in the state. You could travel through the state but not stop over night. The state next to me Illinois does no have a license for its residents. I do not know if her instructor gave her this information.

This is some b/s! This sister shouldn’t get 3 yrs when rich mf out here killing 4 ppl while drunk and molesting their own kids. In GA, you can ride with your Firearm Loaded & Visible long as your not a Felon. You only need concealment permit outside the vehicle & on your person. She shouldn’t have said anything about her weapon & kept it moving. This the Amerikkkan double edged sword, do the right thing, confess to Massa & still find yourself in a bind! I have gotten pulled over with my assault rifle in the car with a 30 round clip but it’s categorized as a hand gun & there was nothing anyone could do b/c I carry all receipts of my Guns in my wallet. Ppl use your brain! Confessions to the Devil only gets you hell b/c we “still” don’t know the rules that they’re consistently changing to keep us in the dark & going to the Slave Ships of prison!

This woman should not have to go to jail for Caring a Conceal weapon, she was never told that she could not care her weapon into another state the only thing that should have happen is that the officer should have told her that she was not suppose to cross state line with a conceal weapon unless she was an police officer, something is wrong with the Judge wanting to put the woman in Jail for three Years that should not be.
