Pregnant Woman Put in Chοkehold During Arrest Over Illegal Grilling

Although the NYPD officially bans the use of chοkeholds, Eric Garner recently passed awaynypd pregnant woman after being placed in one and now video has surfaced of what appears to be a pregnant woman being placed in a chοkehold.

During an incident caught on video, a 7 months pregnant Brooklyn woman, Rosan Miller, 27, wrestles with an officer who places his arm around her neck.

Cops apparently arrived at Miller’s home because she was grilling on the sidewalk, which is illegal in the city. After arriving, however, police ended up in a scuffle not only with the pregnant woman, but her husband and brother as well.

The woman’s husband, Moses Miller, was charged with resisting arrest while her brother, John Miller, was charged with harassment and obstruction of justice, reports the New York Daily News.

Police say the trouble began on Saturday evening at around 7pm when they found Moses Miller grilling and he refused to hand over his ID and began walking away from officers.

Officers say they began attempting to arrest the man but that’s when John and Rosan Miller intervened, slαpping at officers.

After that, according to police, the pregnant woman began resisting arrest.

Former city councilman Charles Barron called for the pregnant woman’s release from jail after learning of the incident.

“This was all over a grill,” Barron said. “This is about grilling in front of her house.”

Barron notes that the woman’s child can be seen in the video watching her mother being chοked. He also claims that at one point the arresting officer called the woman’s husband the “N” word.

“I don’t care what anyone says, there is a powder keg in this town” he added. “ Don’t blame me, the social forecaster, when there is an explosion in this town.”

      I agree that it seems to be getting worse… and I believe it’s because we have a African American President … the media shows him being disrespected all the time…and white people think that shit is “cool” however; they need a focking wake up call and need to be taught a “new lesson” on R E S P E C T !!! And, the best lesson is to fire them and put their azz in jail and all victims sue the City and the Police Department..!!

    Lets see, illegal grilling on sidewalk, asked for ID, ignore officer and starts walking away, officer(s) go hands on and two other individuals start slapping (battery on a police officer), she was not worried about being knocked up at that point, she wanted attention and she got it. Could have went: asked for ID, produced ID, citation issued, everybody gone about their business.

      I concur. Grilling on the front lawn or sidewalk is illegal in most cities/townships. Most states laws require citizens to produce ID upon request of an officer. Your name, address, can be asked. Walking away indicates your intentions to not comply. Since the minor misdemeanor was being committed in their presence, they have a right to make an arrest. Once they announce their intentions to arrest, if you walk away, it’s considered “resisting arrest”. If you struggle, strike, kick, etc. it’s resisting arrest.
      As for pregnant wife/brother. Any person who interferes with the lawful arrest of another can be charged with resisting arrest. A pregnant woman who cares about the safety of her baby would not intervened physically. Many think by doing so, they can change the mind of the officers. All her husband had to do was produce ID, be respectful, accept the citation, move your grill to the back and enjoy their day. A friend who is black and lives in Brooklyn complained to me about her neighbors putting the sofas and chairs on front lawn and grilling. PLEASE!!! You have to pick your battles, restrict cry of racism!

    Another choke hold incident in 2 weeks in NY. Right now my 2 sons are in NY I swear if a NYC cop puts a choke hold or shoots my sons, Believe me their won’t be any marching or protesting. I’m personally going to find out who did it & straight up SHOOT that piece of trash. & u know what? NOTHING will be done to the Cop who killed Eric Gardner. But he’s on desk duty WTF. NY COPS SUCK. No one trust them. Everyone is so outraged about Ravens football player just getting suspended for 2 games, Stupid people forget about him, WHY aren’t you OUTRAGED about these no good cops.

    Anastasia, you sound just a tid bit racist your self. Doing things that are against the law is done by all races, not just blacks and people should be held responsible for their actions. NYPD has been known to be racist and therefore anybody with sense should know to just cooperate until they can get into a position where they are not slaughtered on the streets or beat in the back of a police car or even shot for reaching to scratch an eyebrow, but I’m sure people are all treated equally beneath the rock that you live under.

    CULPABILITY, WHO IS THE TRUE ONE TO BLAME? Lets say there’s a room filled with people. Someone cuts the lights off and accidents happen everywhere in that room. Now who is the true one to blame? The people held responsible for the accidents or the one who turned the lights out? . . . Ask the comentator on ESPN about his domestic violence comment he made now is forced to appologise. . . . Ask the mostly fathers (non custodial parents) about who they blame for the forced label (Non Custodial Parent) they wear as a result of being processed through child support (via Title IV Part D of the Social Security Act – Incentive Payments To The States) That’s right! The feds pay the states to manage the broken families that subject themselves its jurisdiction and now we have “Absentee Fathers, Fatherless Homes, Deadbeat Dads type labels and lifestyle type conditions.
    I think if one look hard enough in the right place, the Constitution provides a remedy to unlawful arrests, search and seizures.

    Lastly, remember Dred Scott! The Federal court told him the Africans and African descendants could never be the citizens mentioned in the Constitution because slaves are considered property. So what does that leave us? The 14th amendment? We are the “Truman Show – In Living Color”

    *sigh* Laws aren’t made to be broken. All he had to do was show a license. This is one instance where they needed to go to jail. Ms. Lady didn’t seem to care about her safety or her baby’s safety when she started slapping on a cop. If that was the case they should go to jail. If the cop is abusing his authority then he should be fired and then sent to jail.

    The police in this case were right. They were right to where necessary after women refused to comply and knowing Barbeqing on the sidewalk is illigal. She’s lucky someone in her family didn’t get seriously injured.

    I don’t know. I can’t EVER imagine having to produce an ID to a cop for letting someone go in with me on a pack of cigarettes, or for grilling on a sidewalk because my apartment doesn’t come with a yard. Seriously?!! That’s the real reason why everyone is outraged. Not because they’re black. I too would say to that cop … “I don’t think so, go find someone else to harass”.

    If law enforcement is called, as these apparently were, they have to make a report. They’re not gonna just take your word for identification, you must show your I.D. if you have one. You do NOT have a right to refuse to show your I. D.! It matters not how you feel, it’s the law! Black folk need to know what our rights are, and stop trying to make them up as we go. Why do you think that you don’t have to obey the police? Nobody, black or white has that right. I’ve seen white men and women get a beat down for resisting, and disobedience is resisting. The husband was the one that refused to show his I D, and they did what they were supposed to. Take him into custody or lose their jobs. So what do you think that they were going to do? His wife tried to fight, so how was he to restrain her, grab her around the waist? Wake up Black People! What if he or his wife had been killed? Would that have been better than showing an I.D.?

    This trend with police mistreatment could be stopped by using unconventional tactics. What if they (police) knew with statistical certainty that following one of these incidents of mistreatment, that one of their neighbors, friends or relatives was definitely going to be sniped at random ? Do you think these neighbors, friends, and relatives would implore them to NOT engage in this type of brutal behavior ?

    This is a newspaper targeted at the Black community. I do understand the stories of the actions of bigots in power and how they specifically seek us out for mistreatment….but, I would love to find out if the granting of power over others as the Police have, has anything to do with the behavior of some of the individual policemen. How many whites experience unfair Police brutality? Does the expected danger associated with carrying out their jobs get to some and make them become brutes and misuse their power? We only get to see part of the issue. As the saying goes, “There is one side and there is the other side and then there is the truth” I do not like the idea of a fetus being threatened, but did the pregnant woman think about her baby before she got into a brawl? My 911 call would have brought more cops to the scene if I was unduly threatened to call off their out of control co-workers. Just asking,………………!

    Okay sucks to be the pregnant chick but i live in new kersey and work in new york…grillin on the public sidewalk is ILLEGAL (and ghetto) and cops will write you a ticket now another thing if you breakin a law the cop have legal right to ask for your id and you have to give it…but if cop just stops you for nothin cop has to tell you why hes askin. Dude was wrong for not showin his id when he was breakin the law so the cop went to handcuff him and he went off and the others went off and started screamin the cop so the cop took them in. The woman was resisting arrest and put her in that chokehold. Riddle me this whh do some kf our ppl have trouble obeyin laws? NY ppl know grillin or cookin anything on the sidewalk is illegal thats why hotdog vendor or anybody that cooks on the sidewalk have to have license and inspection papers saying their cart passed inspection for bein safe and clean. And they acted stupid in front of their little girl. Yeah the cop was wrong but they was wrong too. Some blkppl just hell bent on breakin laws and bein belligerent. All dude had to do when the cop asked for his id was show it becuz he was breakin the law and the cop woulda wrote him a ticket and that would have been that. They wasnt just innocently standin around they was cookin on the sidewalk that is a crime can we stop bein stuck on stupid and just obey the law and stop grillin on the sidewalk its illegal and ghetto as helk you wanna grill take the grill and the fam to the park and grill. Or buy a house and grill in the backyard like everybody else. Me and my hubby grill in the backyard we dont drag the grill on the sidewalk that is tacky and ignorant. My family use to live in Newark NJ worse fukkibln place on the map me and my brotha wasnt even allowed to play outside half the time becuz the mawfukkas shootin & sheit or fightin and sellin drugs. Horrible fuckin place. Pops moved us to Morristown difference is like night and day i love it here peaceful QUIET took us a minute to get used to the quiet. Hubby and I have a house out here and my brotha and his wife and new baby out in Lawrenceville NJ. WHY somma yall make life so hard for the decent blkppl then when we get money we leave becuz yall keep sheit goin 24/7. Its mostly whites in Morristown and Lawrenceville but these ppl dont bother us just say hello how you doin and keep goin. Nobody standin around no sound of gunshots no loud music with base bumpin just peaceful i dont lock up my car aint no bars on my windows just my alarm system. IlMe and my hubbh can sit on our deck and feel safe. Now why did my family have to move away from our ppl to live a better quality of life and why do we all feel safer in a white neighborhoods than we did in Newark? Cuz aint nonna that sheit that go on in the hood is goin on out here. Yall runnin blkppl with money out the hood that hurts yall more than it hurt yall becuz the less blk with money the less they care about yall and the hood so they just gonna let the hood crumble thats bad for yall becuz less homeowners less money less govt will invest in fixin up the hood.

    I am a forty nine year old black man. I have had a few scrapes with the law a few years ago. I was wrong I learned my lesson and moved on. These cops is crackers we all know that. Don’t give them a reason to beat you down.

    Stop acting ghetto and don’t let your ego get in the way. Just say yes officer, no officer, can I shine your shoes sir. Most of these crackers are too stupid to know you are insulting them by being nice to them.

    If you treat them like what they really are (a paramilitary extrajudicial execution arm of the institutionally racist judicial system) then you wont generally have any problems. They are that bad and if you realise that they are the Gestapo then you can avoid them.

    That doesnt mean fear them but avoid them. You wouldnt swim with sharks, or walk around the woods with a bag bloody steaks. Dont challenge cops. Don’t give them an excuse to beat you down.
