Ex-wife of R&B singer Usher, Tameka Foster, filed legal documents in Fulton, County, Ga., on Tuesday, demanding emergency custody a day after their eldest son, Usher Raymond V, nearly drowned in Usher’s pool August 5.

Since Usher and Tameka’s divorce in 2009, Foster has been battling the Grammy award winning singer for custody of their two sons, Naviyd Ely Raymond and Usher Raymond V. Foster claims that 34-year-old Usher, who has primary custody of the two boys, allows unfit caretakers to watch after their children. Because of the lack of proper guidance, Foster believes her children are in an unsafe environment at Usher’s home in Georgia.

Tameka claims that Usher is out of the home “85% of the time and has failed to exercise physical custody by utilizing “third-party” care givers…rather than personally exercising parenting time.”

Usher V was hospitalized after nearly drowning in his father’s pool on August 5. According to TMZ, the 5-year-old’s arm got stuck in the pool’s drain and nearly drowned the boy while he struggled to get his arm out of the hole. Usher V eventually got his arm free and was given CPR and rushed to the ICU. Usher’s aunt, Rena Oden, was in charge of watching Usher and Naviyd the day of the accident. Usher was not home when all of this occurred.

Rena Oden was never on Tameka’s good side. In the past, Tameka claimed that Rena once allowed a stalker into Usher’s home and also is too physical in disciplining the young boys.

Tameka was granted the emergency custody Wednesday morning.

This tragedy isn’t Tameka’s first scare. In 2012, Tameka’s eldest son, Kile Glover, died after he was struck in the head by a jet ski during a family vacation.

Pray for little Usher.
